Do you or even the seller know everything that has been done on a tract of land? Probably not. You should include in your due diligence study period of your contract, the ability to conduct a Phase I environmental assessment of the property. This assessment will review the uses of the property in the past through public records, aerial imagery and so forth to determine if there are any potential environmental problems on the property.
If problems are uncovered then the seller has the right to correct the problems or you can terminate the contract (if stated in the terms of the contract). By conducting an environmental assessment, you decrease the possiblity of ever being held responsible if an old environmental hazzard is ever found on the property.
